Why the NCAA looks so helpless in Texas Tech case, plus NIL in video games

Why the NCAA looks so helpless in Texas Tech case, plus NIL in video games

The NCAA's ongoing struggle to enforce its own rules has never been more visible than in the current standoff with Texas Tech. The governing body appears nearly helpless, and the reasons go far beyond one case. For years, the NCAA relied on the threat of the "death penalty" or postseason bans to keep member schools in line. That leverage is gone. Schools now know that any severe punishment will be met with immediate litigation, and the courts have consistently sided with the athletes and the institutions. Texas Tech, like many others, understands that the NCAA's legal footing is shaky at best. The organization can threaten, but it can barely investigate without facing a lawsuit that questions its very authority. The result is a slow, public breakdown of enforcement.

Meanwhile, the conversation around Name, Image, and Likeness has taken a new turn. The idea of college athletes appearing in video games is no longer a hypothetical. With the rise of NIL collectives and direct licensing deals, the path for players to get paid for their digital likenesses is clearer than ever. The old model, where EA Sports paid nothing to the actual players and used generic avatars, is dead. Now, the question is how to manage a system where hundreds of athletes on a single roster all demand a cut. It is a logistical nightmare for game developers, but a massive win for the players. The NCAA, which once fought this concept tooth and nail, now has no choice but to watch from the sidelines as the money flows directly to the talent. The old guard has lost control, and there is no sign they will ever get it back.
