Devolver Digital has taken legal action against a toy manufacturer who has been publicly stating that he is developing a spinoff game based on the Hotline Miami franchise. The lawsuit centers on claims that the toy maker, despite once having a legitimate licensing deal for toys and pins, has overstepped his agreement by repeatedly announcing a video game project that was never authorized.
According to court documents filed this week, the two parties did once have an agreement for toys and pins. That deal, however, did not extend to game development. Devolver Digital argues that the toy maker has been misleading fans and the press by insisting that a Hotline Miami spinoff is in the works, which could damage the brand's reputation and confuse consumers.
The toy maker has not yet issued a formal response to the lawsuit. Legal experts suggest that the case will hinge on whether the toy maker's public statements were simply enthusiastic speculation or a deliberate attempt to exploit the Hotline Miami name without permission. Devolver Digital is seeking an injunction to stop the toy maker from making further claims about the spinoff, as well as unspecified damages for trademark infringement and breach of contract. The outcome could set a precedent for how licensing agreements for merchandise are interpreted in the gaming industry.
